K-12 Legislation passed 2014-2016 Legislative session relating to Student Safety

SB 326 (Beall) – Sex offenders. Authorizes the chief administrative official of a school to grant a registered sex offender, who is not a family member of a pupil who attends that school, permission to come into a school building or upon the school grounds to volunteer at the school provided that, at least 14 days prior to the first date for which permission has been granted, the chief administrative official notifies the parent of each student attending the school that a person who is required to register as a sex offender has been granted permission to come into a school building or upon school grounds, the date or dates and times for which permission has been granted, and his or her right to obtain information regarding the person from a designated law enforcement entity. SB 967 (De Leon) – Student safety: sexual assault. Requires the governing board of each community college district, the Trustees of the California State University, the Regents of the University of California, and the governing board of independent postsecondary institutions to adopt a policy concerning campus sexual violence, domestic violence, dating violence and stalking that includes specified components. SB 1165 (Mitchell) – Pupil instruction: sexual abuse and sex trafficking prevention education. Requires the Instructional Quality Commission, when revising the health framework, to consider including a distinct category on sexual abuse and sex trafficking prevention education, and authorizes a school district to provide sexual abuse and sex trafficking prevention education. The bill also encourages school districts to collaborate with outside consultants, including law enforcement, with expertise in sexual abuse and sex trafficking prevention education in order to create a school safety plan to address the threat of sexual abuse and sex trafficking. AB 449 (Muratsuchi) – Elementary and secondary education: certificated school employees: allegation of misconduct. Requires a superintendent of a school district or county office of education, or the administrator of a charter school to report changes in the employment status of certificated employees that result from allegations of misconduct to the Commission on Teacher Credentialing. The bill also constitutes failure to report as a misdemeanor that is punishable by a fine of between $500 and $1000. AB 549 (Jones-Sawyer) – Comprehensive school safety plans: mental health professionals and police role on campus guidelines. Encourages schools to include in school safety plans, when plans are reviewed and updated, guidelines for the roles and responsibilities of mental health and intervention professionals, school resource officers and police officers on the school campus. AB 1271 (Bonta) – School safety plans: pupil mental health care. Requires, rather than authorizes, as school safety plans are reviewed and updated that the guidelines for the roles and responsibilities of mental health professionals, community intervention professionals, school counselors, school resource officers, and police officers on school campuses contained with a school safety plan to include (a) primary strategies, and (b) protocols to address the mental health care of pupils who have witnessed a violent act at school. AB 1432 (Gatto) – Mandated child abuse reporting: school employees: training. Requires local education agencies to annually train employees on their duties regarding the mandated reporting of child abuse and neglect. AB 1433 (Gatto) – Student safety (Urgency). Requires postsecondary educational institutions to establish policies regarding the reporting of specified crimes to local law enforcement. AB 1442 (Gatto) – Pupil records: social media. Requires a local education agency that considers a program to gather or maintain in its records any personal information obtained from social media of any enrolled pupil to notify pupils and their parents about the proposed program. AB 1455 (Campos) – Pupils: bullying: counseling services. Authorizes schools to refer a victim of bullying, or other students affected by bullying, for case management, counseling, and participation in a restorative justice program. AB 2016 (Campos) – Pupil instruction: sexual abuse and sexual assault awareness and prevention. Requires the State Board of Education to consider including, in the next revision of the health standards, content related to sexual abuse and sexual assault awareness and prevention. The bill also requires the Instructional Quality Commission to consider including this content in the next revision of the health framework. AB 2560 (Bonilla) – Teacher credentialing: applications: child abuse reporting. Requires the Commission on Teacher Credentialing to require a credential applicant (initial or renewal) to read and attest by electronic signature a statement regarding his or her duties as a mandated reporter. SB 242 (Monning) – School security: surplus military equipment. Requires a school district’s police department to obtain approval from its governing board prior to receiving federal surplus military equipment and also requires the governing board of a school district to provide a detailed description of the function and purpose of the military equipment being acquired. SB 527 (Liu) – Education finance: Safe Neighborhoods and Schools Fund: Learning Communities for School Success Program. Establishes a grant program, to be administered by the California Department of Education that furthers the purpose of Proposition 47 in reducing truancy and supporting students who are at risk of dropping out of school or who are victims of crime. This bill is identical to AB 1014 (Thurmond, Chapter 397, Statutes of 2016). SB 695 (De León, Jackson) – School curriculum: health education: sexual harassment and violence instruction.  Requires school districts that require completion of a course in health education as a condition of high school graduation to include instruction in sexual harassment and violence, and requires the Instructional Quality Commission, during the next revision of the health framework, to consider including comprehensive information for grades 9-12 on sexual harassment and violence.

SB 1178 (Vidak) – Superintendent of Public Instruction: child abuse and neglect: poster. Requires the Superintendent of Public Instruction to develop a poster that notifies children of the appropriate resources available for reporting child abuse or neglect. AB 827 (O’Donnell) – Safe schools: Safe Place to Learn Act: lesbian, gay, bisexual, transgender, and questioning pupil resources. Requires the California Department of Education to assess whether local educational agencies have provided to certificated employees in schools serving grades 7-12, as part of the existing requirement to provide information relative to anti-discrimination policies, information on existing school site and community resources to support students who are lesbian, gay, bisexual, transgender, and questioning. AB 1058 (Baker) – Pupil safety: child abuse prevention: training. Requires the California Department of Education to establish best practices for child abuse prevention and post on its Web site links to existing training resources. AB 2536 (Chau) – Pupil discipline and safety: sexual bullying. AB 2845 (Williams) – School safety: Safe Place to Learn Act.  Requires the California Department of Education (CDE), as part of its existing compliance monitoring activities, to assess whether local educational agencies have provided information to certificated staff serving students in any of grades 7-12 and community resources for students who may face bias or bullying on the basis of religious affiliation or perceived religious affiliation.
